Your order is an offer to purchase the products you specified ("Products") according to the terms and conditions below. These terms will become a contract ("Agreement") when your order is accepted by VortexMount either by sending to you order confirmation and by shipping your product. You represent you have the legal authority to enter into this agreement on behalf of yourself or any party you represent. 

 

2. Returns.

All returns must be made within thirty (14) days of the delivery date and include proof of purchase, a copy of your original order or email you received with order number. No products shipped hereunder may be returned without VortexMount’s prior approval and RMA number. In order to return a product, the buyer must obtain an RMA number (Return Merchandise Authorization Number). Items returned without a valid RMA number may be rejected.

3. Shipping.

Shipping charges may be an additional cost. We offer a variety of shipping options. P.O. Box, APO, and FPO addresses cannot be shipped to using UPS

 

4. Risk of Loss.

Risk of loss will transfer to you when VortexMount delivers your order to the delivery service. If the shipping service marks the packaged as delivered, we have no control over where the package is. Its customer's responsibility to contact delivery provide and find out where the package was placed. 

 

5. Payment Terms.

VortexMount accepts most credit cards. We do not offer paypal since their customer service is horrible. Your credit card is charged at the time of your order.

 

6. Limited Warranty.

 

THIS LIMITED WARRANTY DOES NOT EXTEND TO ANY PRODUCT WHICH HAS BEEN DAMAGED AS A RESULT OF ACCIDENT, MISUSE, ABUSE OR AS A RESULT OF UNAUTHORIZED SERVICE. THIS WARRANTY IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES FOR THIS PRODUCT. IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT SHALL HAVE NO GREATER DURATION THAN 1 YEAR FROM THE DATE OF PURCHASE. IN THE EVENT THIS PRODUCT BECOMES DEFECTIVE DURING THE WARRANTY PERIOD, THE PURCHASER'S EXCLUSIVE REMEDY SHALL BE REPAIR, REPLACEMENT OR REFUND AS PROVIDED ABOVE. 

IN NO EVENT SHALL VORTEXMOUNT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROPERTY, ARISING FROM BREACH OF ANY EXPRESSED OR IMPLIED WARRANTY.

 

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusion may not apply to you. 

 

7. Products.

VortexMount may revise or discontinue certain products at any time. VortexMount will ship products that have the functionality and performance of the products ordered, but differences between what is described and what is shipped are possible.

 

8. Limitation of Liability.

VORTEXMOUNT TOTAL LIABILITY WHETHER FOR BREACH OF CONTRACT, WARRANTY, LATE DELIVERY OR NON-DELIVERY, NEGLIGENCE, STRICT LIABILITY IN TORT OR OTHERWISE, IS LIMITED TO THE PRICE OF THE PARTICULAR PRODUCT(S) SOLD WITH RESPECT TO WHICH LOSSES OR DAMAGES ARE CLAIMED. IN NO EVENT WILL VORTEXMOUNT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, INDIRECT, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING ATTORNEY FEES ARISING OUT OF THE USE OF OR THE INABILITY TO USE THE PRODUCTS, OR FOR ANY CLAIM BY ANY OTHER PARTY, EVEN IF VORTEXMOUNT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

 

9. Compliance with the Law; Resale Sales and U.S. Government Sales Not Intended.

You agree to comply with all applicable laws and regulations of the various states and of the United States and other countries that relate to the Products or this Agreement. 

 

VortexMount has separate terms and conditions governing the sale of Products to the U.S. Government and registered Resellers. 

 

10. Amendment.

This Agreement may not be altered, supplemented, or amended by the use of any other document(s). Any such attempt will be null and void unless otherwise agreed to in a written agreement signed by both you and VortexMount. 

 

11. Severability.

If any provision of this Agreement is held to be invalid or unenforceable by any law, rule, order or regulation of any government or by the final determination of any state or federal court, such invalidity or unenforceability of any one or more of the provisions hereof shall not affect the validity or enforceability of the other provisions hereof.

 

12. Discounts and coupon codes.

VortexMount periodically offers special discounts on items via direct discount or coupon code. Items being offered with a direct discount will have their final sale price reflected during checkout. Any discount offer with a coupon code will require that the code be entered by the customer on the checkout screen. Unless otherwise stated, coupon codes are limited to one per order and may not be combined with any other offer.

 

VortexMount notifies customers of upcoming discounts using social media and email. Sign up for special offer emails here. Discounts are valid during specified timeframes only. Orders completed before or after specified timeframes are not eligible for that discount.

 

VortexMount reserves the right to cancel any discounts or coupon codes at any time.

 

13. Clearance items.

VortexMount offers a significant discount on select overstocked items in our Clearance section.

These items are offered on clearance discount while supplies last. No rainchecks or backorders on these items will be offered.

 Unless otherwise stated these items are excluded from all coupons, sales, and special offers. All sales of clearance items are final. No returns of clearance items will be accepted.
